Hill Ward Henderson Shareholder, Gregory P. Brown, is scheduled to present at the American Conference Institute’s National Forum on Litigating Contract Surety Bond & Fidelity Insurance Claims on October 17- 18th at Union League in Philadelphia, PA. The Forum is the premier event where outside counsel, leading in-house counsel and claims professionals are meeting to devise practical solutions for today’s most critical issues.
Mr. Brown will be presenting on “How to Draft Indemnity Agreements to Hold the Surety Harmless.” He will discuss defenses to indemnifying the surety: overpayment of payment bond claimants including sub contractors and suppliers. In addition, he will explain the right of the surety to obtain collateral, records and to review losses in “good faith,” how to interpret case law in enforcing indemnity agreements and will discuss problems with enforcing indemnity agreements when the principal is lacking funds.
Mr. Brown’s practice primarily involves construction litigation, concentrating in the representation of developers, contractors and sureties in defect cases, contract bond litigation and bankruptcy proceedings related to construction and lending. He has represented several of the nation’s largest homebuilders in matters ranging from class action defect litigation to turnover and post-turnover homeowner association disputes. Mr. Brown also successfully argued a bankruptcy appeal firmly establishing the superiority of a surety’s equitable rights to contract proceeds over a Chapter 7 bankruptcy trustee, creating a significant national precedent.
