
Ben is a Shareholder in the firm’s Construction Law Group. As a Board Certified Construction Attorney, his practice primarily involves complex construction litigation claims involving contracts, construction defects, design errors, and construction liens. Ben represents owners, developers, contractors, construction managers, design professionals and subcontractors in all phases of the construction process.
Active in both professional and bar related activities, Ben is a member of the Construction Law Section for the Hillsborough County Bar Association. He has authored articles and spoken at seminars on various construction law topics, and is also an active member of the Forum on the Construction Industry for the American Bar Association.
Representative Experience:
- Represented publicly traded general contractor against owner, insurers and subcontractors in $6 million construction defect claim regarding construction of multi-family condominium and apartment project.
- Represented publicly traded real-estate investment trust & general contractor against insurers and subcontractors in $10 million construction defect claim regarding construction of multi-family apartment project.
- Represented architect in $5 million professional malpractice and delay claim case regarding the design and engineering of mixed-use facility, including four buildings and approximately 102,000 square feet of retail, office and condominium units.
- Represented construction manager against general contractor and engineer regarding extra work and delay claims for the construction of $107 million waste-to-energy facility.
- Represented publicly traded national home builder against community development district in $10 million arbitration regarding construction defect and fiduciary claims for subdivision of 1,500 single family homes.
Ben serves on the Board of Directors for the Children's Dream Fund, a nonprofit organization which fulfills the dreams of children suffering from life-threatening and debilitating illnesses. Ben is also a founding member of the First Team, an advocacy & fundraising group for the Children's Dream Fund. In addition, Ben is as an active member and past Board of Director for the 13 Ugly Men Foundation, Inc., a nonprofit organization that raises funds and awareness for local charities.
